An individual has sadly passed away after an unfortunate head-on-collision in New York. Meanwhile, another person was injured in the two-car crash as well. Sometimes, these types of car accidents occur as a result of a driver’s carelessness, which can be grounds for litigation.
Events leading up to the car wreck
The recent crash took place at a little before 2 p.m. on a Monday. According to police, a car was heading west along a road. Meanwhile, a commercial vehicle was heading east on the road. The two automobiles then reportedly crashed head-on into each other.
The car’s driver ended up passing away at the scene. Meanwhile, the individual driving the commercial automobile suffered injuries and was therefore transported to a medical center, where the driver’s injuries were considered not to be life threatening. Police said it was not immediately clear which automobile breached the road’s middle line and thus caused the collision.
How an attorney can help
Police may determine through their investigation that the commercial automobile driver caused the accident due to negligent behavior behind the wheel. In this situation, the surviving loved ones of the car driver may opt to file a wrongful death claim against the commercial vehicle driver, seeking the reimbursement of monetary damages. Liability has to be established before a judge in New York will decide a claim for damages. If the plaintiffs are successful in their claim, they may be awarded financial damages to cover their loved one’s burial costs and other expenses resulting from the head-on accident.
