On Behalf of | May 7, 2022 | Pedestrian Accidents |

A man’s life has sadly been lost in a tragic pedestrian accident in Brooklyn. Now, his family members are left to grieve over his death. Another man now faces charges in connection with the Saturday morning accident.

How the crash occurred

The recent pedestrian accident took place at about 9:35 a.m. According to police, a 48-year-old man was standing on a street between two cars that were parked. All of a sudden, a 46-year-old driver reportedly collided with one of these parked cars while waiting for a fellow driver to pass.

Police said the pedestrian ended up being crushed between the parked cars. The impact of the crash allegedly caused him to sustain head trauma and left him unconscious. Although he was rushed to a medical center, he was later pronounced deceased there. Authorities arrested the driver who reportedly caused the crash.

Legal recourse possible for surviving loved ones

The surviving loved ones of the man who died in the pedestrian accident may decide to file a wrongful death claim against the driver who allegedly caused the New York crash, seeking the reimbursement of monetary damages sustained. If the driver is criminally charged and then convicted on those charges, proof of the conviction may be presented in a New York civil court with the goal of establishing liability for the accident. Only once liability is established will the wrongful death claim be decided. A successfully fought claim may lead to a financial damage award to cover the deceased pedestrian’s funeral costs and other accident-related losses.
